Introduction

Welcome to the Fragola Creator & Affiliate Program (the “Program”), powered by Social Snowball. The Program rewards our creators and affiliates for referring new customers to Fragola products, and allows us to feature creator content across our marketing channels. By applying to or participating in the Program, you agree to these Terms & Conditions. Please read them carefully. In these terms, “Fragola”, “we”, “us” and “our” refer to Fragola Brand Lda; “you” refers to the participating creator or affiliate.

Eligibility

You must be 18 years of age or older to participate.
You must have an active and valid method of receiving payment.
Fragola may approve or reject any application, and may remove any participant, at its sole discretion.

Program Participation

You will receive a unique referral code and/or link to share with potential new customers. Your code must be unique to you; codes that duplicate or conflict with Fragola’s own promotional codes are not permitted.
Commissions are earned only on qualifying sales directly and verifiably attributable to your referral code or link, as tracked by Social Snowball.
You are responsible for ensuring your promotional methods comply with all applicable laws, platform rules, and advertising-disclosure requirements (for example, clearly disclosing paid or affiliate relationships, such as #ad or #affiliate, where required).
Commissions apply to first-time / new customers and are valid for one use per customer, unless stated otherwise in your specific offer.

Commission & Payments

Commission rates and discount terms are set by Fragola and may change at our discretion. We will notify you of material changes.
Payment of commission is contingent on Fragola’s collection and retention of funds from the referred customer. Returned, cancelled, refunded, or charged-back sales will result in deduction of the corresponding commission from your balance.
All commissions are subject to review and verification by Fragola to protect the integrity of the Program. We may delay or withhold payment while a review or investigation is conducted.
Commissions earned through fraudulent, illegal, deceptive, self-referring, or overly aggressive or questionable sales or marketing methods will be voided. This includes a participant using their own code for personal purchases where prohibited by their offer.
Fragola may withhold or delay payment of commissions pending investigation of any suspected breach of these terms.

Content & Usage Rights

By participating in the Program and creating content that features Fragola products, you grant Fragola a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, adapt, display, and distribute that content across our marketing channels — including our organic social media, our website and email, and paid advertising on platforms such as Meta (Facebook/Instagram) and TikTok — for the duration of your participation and for a period of twelve (12) months afterwards. Where the format allows, we will credit you.

This licence is non-exclusive: you keep ownership of your content and may continue to use it yourself. Separate from this licence, running ads from your own social handle (e.g. TikTok Spark Ads or Meta Partnership Ads) is optional and arranged separately, with your express consent and any agreed additional compensation; nothing in these terms grants Fragola access to your social accounts.

You confirm that any content you provide is your own original work (or that you have the necessary rights to it), and that it does not infringe the rights of any third party, including any other people featured in it.

Coupon & Deal Sites

Posting your codes or links on coupon, deal, or discount-aggregator websites (such as Honey, RetailMeNot, CouponBird, and similar) is strictly prohibited. Allowing your code to be posted on such sites is treated the same as posting it yourself.
Participants found sharing or allowing codes on such sites may be immediately terminated from the Program and forfeit any pending commissions.
You are encouraged to report any unauthorised use of your code to Fragola for investigation.

Intellectual Property & Brand Use

You may not alter Fragola brand assets (logos, images, names) without our prior written consent.
All promotional materials must be used in a manner that is respectful, lawful, and consistent with Fragola’s brand guidelines. You may not make false or misleading claims about our products.

Data Protection

Fragola will process your personal data (such as your name, contact details, payment information, and performance data) to operate the Program, in accordance with applicable data-protection law including the GDPR. For details on how we handle your data and your rights, see our Privacy Policy.

Termination

Either party may end the affiliate relationship at any time with written notice.
On termination, you must stop using Fragola branding, promotional materials, and referral links or codes. Content licence rights already granted under “Content & Usage Rights” survive for the period stated there.

Limitation of Liability

To the extent permitted by law, Fragola will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with the Program, even if advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law.

Amendments

Fragola may update these Terms & Conditions from time to time. We will take reasonable steps to notify participants of material changes. Continued participation after changes take effect constitutes acceptance of the updated terms.

Governing Law

These Terms & Conditions are governed by the laws of Portugal. Any disputes arising in connection with the Program shall be subject to the exclusive jurisdiction of the competent Portuguese courts.

Agreement

By applying to or participating in the Fragola Creator & Affiliate Program, you confirm that you have read, understood, and agree to these Terms & Conditions. You understand that violation of any term may result in termination of your participation and forfeiture of any accrued commissions.
